arbitration

(noun)

A process in which two or more parties use an adjudicator in order to resolve a dispute.

Examples of arbitration in the following topics:

  • Collective Bargaining

    • These disputes then go to arbitration, which is similar to an informal court hearing.
    • A neutral arbitrator makes a ruling as to whether the termination was unjust and whether other contract breaches occurred.
    • If so, the arbitrator will order that the breach be corrected or remedied in some way.
  • Cooperative Strategy

    • Contract negotiation involves determining whether all parties have realistic objectives; forming high-caliber negotiating teams; defining each partner's contributions and rewards as well as protecting any proprietary information; addressing termination clauses and penalties for poor performance; and highlighting the degree to which arbitration procedures are clearly stated and understood.
